SwipeReply – AI-Powered Instagram Comment Replies

1. Who We Are

SwipeReply is operated by the German startup hub "Denkfabrik" (Dnkfbrk GmbH) which means "Thought Factory" and is about creating simple, well designed products that empower founders to grow. Dnkfbrk GmbH is located in Kollwitzstr. 76, 10405 Berlin ("we", "us", "SwipeReply"). By creating an account or using SwipeReply you agree to these Terms. If you do not agree, please do not use the Service.

2. What SwipeReply Does

SwipeReply is an AI-powered tool that drafts replies to comments on your own social media posts. It analyses your recent replies, tone, emoji habits, post captions, and video transcripts to generate suggested responses that match your voice.

You review every draft through a swipe-based interface: approve, reject, or edit before anything is posted on your behalf. SwipeReply never posts without your explicit approval, unless you have activated the optional Autopilot feature for low-risk comment intents (available on the Pro plan), in which case replies are posted automatically within the parameters you define.

SwipeReply currently supports Instagram via the official Instagram Graph API. Support for TikTok, YouTube, X (Twitter), and LinkedIn is in closed beta and subject to availability.

3. Eligibility & Account

You must be at least 16 years old to use SwipeReply. By registering you confirm that you are the rightful owner or an authorised manager of the connected social media account(s). You are responsible for keeping your login credentials secure and for all activity under your account.

4. Subscriptions & Payment

4.1 Plans

SwipeReply offers Starter, Growth, and Pro plans with monthly or annual billing. Current plan details and prices are listed on our pricing page. We reserve the right to adjust prices with at least 30 days' prior notice. Price changes do not affect your current billing cycle.

4.2 Payment Processing

All payments are processed by Stripe. We do not store your full credit card details on our servers. By subscribing you authorise recurring charges through Stripe.

4.3 Cancellation

You may cancel your subscription at any time in your account settings. Cancellation takes effect at the end of the current billing period. There are no cancellation fees.

4.4 Right of Withdrawal (EU/EEA Consumers)

If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal from the date of purchase under the EU Consumer Rights Directive (Directive 2011/83/EU) and § 355 BGB. To withdraw, send a clear statement to hi@swipereply.com within 14 days of subscribing. If you have already used the Service during this period, you may be charged proportionally for the usage received.

5. Your Content & Responsibilities

5.1 Ownership

You retain full ownership of all content you create, post, or approve through SwipeReply. We do not claim any intellectual property rights over your comments, replies, or social media content.

5.2 Your Obligations

You agree to: (a) comply with the terms of service of the connected social media platforms, (b) not use SwipeReply for spam, harassment, hate speech, or any unlawful purpose, (c) not misrepresent AI-generated replies as human-written where disclosure is legally required, and (d) not reverse-engineer, scrape, or attempt to extract the underlying AI models.

5.3 Creator Rules

SwipeReply allows you to set rules for tone, banned words, and safe topics. You are responsible for configuring these rules. We are not liable for replies that were approved by you or sent via Autopilot within your defined parameters.

6. AI-Generated Content

SwipeReply uses third-party AI providers (including Anthrophic, OpenAI and Google Gemini) to generate draft replies. AI outputs are suggestions only and may occasionally be inaccurate, inappropriate, or off-tone.

You are solely responsible for reviewing and approving any reply before it is posted. We strongly recommend reviewing all drafts, even when using Autopilot. SwipeReply is not liable for consequences arising from replies you approved or that were sent through Autopilot settings you configured.

We do not use your data to fine-tune AI models unless you explicitly opt in.

7. Data & Privacy

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection law. For full details on data collection, storage, third-party processors, and your rights as a data subject, please refer to our Privacy Policy.

8. Availability & Service Changes

We aim to keep SwipeReply available and reliable, but we do not guarantee uninterrupted or error-free service. We may update, modify, or discontinue features at any time. Where changes materially affect your use, we will provide reasonable advance notice.

9. Intellectual Property

The SwipeReply name, logo, brand, website design, and underlying technology are owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to use our branding without written permission.

10. Limitation of Liability

10.1 General

To the maximum extent permitted by applicable law, SwipeReply's total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10.2 Mandatory Liability (German Law)

Nothing in these Terms limits or excludes our liability for: (a) intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), (b) injury to life, body, or health, (c) liability under the German Product Liability Act (Produkthaftungsgesetz), or (d) any other liability that cannot be excluded by law.

10.3 Disclaimer

SwipeReply is provided "as is". To the extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated drafts will be accurate, appropriate, or suitable for your audience.

11. Indemnification

You agree to indemnify and hold SwipeReply harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) replies you approved or sent via Autopilot, (c) your breach of these Terms, or (d) your violation of any third-party rights, including platform terms of service.

12. Governing Law & Disputes

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer in the EU/EEA, mandatory consumer protection provisions of your country of residence apply in addition.

12.2 Jurisdiction

For business users, the exclusive place of jurisdiction is Berlin, Germany. For consumers in the EU/EEA, you may bring proceedings in the courts of your country of residence or in Berlin.

12.3 For Users in the United States

If you are located in the United States, the following applies in addition: you and SwipeReply agree to resolve any disputes through binding individual arbitration administered under the rules of the German Arbitration Institute (DIS) in Berlin, except where prohibited by law. You waive any right to participate in class actions or class-wide arbitration.

12.4 Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, but we are always happy to resolve issues directly at hi@swipereply.com.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of SwipeReply after the effective date constitutes acceptance. If you disagree, you may cancel your subscription before the changes take effect.
